Montgomery, Alabama, United States, September 8, 2026 -- Leading probate and estate planning attorney Davis Hartley has revealed why inheriting a family home can become a source of unexpected conflict, often leading to legal disputes and even court-ordered sales.

Davis Hartley, founder and attorney at The Hartley Firm, said one of the most common causes of inherited property disputes is uncertainty surrounding a will or estate plan, which leaves family members to interpret the property's future differently.
"One sibling may want to keep the home because of its emotional significance, while another may believe selling is the best financial decision," Hartley said. "Without clear instructions from the estate plan, those differences can quickly become major disputes."
Disputes often intensify when heirs hold unequal ownership interests or face different financial circumstances. Since inheritance laws vary by state, Hartley said understanding Alabama's requirements is essential before making decisions about the property.
"If family members are unable to reach a compromise, a disagreement can escalate into litigation," Hartley said. "In some situations, a court may ultimately order the property to be sold so the proceeds can be divided among the heirs."
A buyout agreement can offer a practical alternative: one heir purchases another's interest, keeping the property in the family while providing fair compensation.
"Buyout agreements can be an effective solution when they're properly structured," Hartley said. "Working with an experienced attorney helps ensure the agreement protects everyone's interests and complies with Alabama law."
Outstanding debts can also force a sale. If the deceased left behind mortgages, taxes, or other liabilities, heirs may have little choice but to sell, particularly since creditors may place liens that complicate transferring ownership. Maintenance costs add further strain when heirs disagree over repairs, insurance, or upkeep—especially if some already carry the costs of their own homes.
"In many cases, selling becomes the most practical way to pay creditors and distribute the remaining proceeds," Hartley said. "When the costs of keeping a property outweigh the benefits, selling is often the best solution."
To avoid costly litigation, Hartley encourages families to communicate openly and consider mediation early.
"Mediation often allows families to work through disagreements in a less adversarial setting," Hartley said. "It can preserve relationships, reduce legal expenses, and help everyone reach a mutually acceptable resolution."
Hartley also recommends seeking legal guidance before disputes escalate, noting that probate attorneys can clarify each heir's rights and help families avoid unnecessary delays and expenses.
"The best time to prevent inherited property disputes is during the estate planning process," Hartley said. "Clearly documenting what should happen to a family home can provide valuable guidance for heirs and significantly reduce the likelihood of future disagreements."
